Refund & Cancellation Policy: 

Sparx offers a generous and consistent refund and program  credit  policy. We know that things can change and we want to be fair to you while protecting our small business:

  • If you request a refund with 30 days or more before the first class, we will happily give you a  full  refund minus  a $20  processing &  admin fee per program/product purchased. Or  see below for our credit  policy.

  • If you request a refund between  29 – 8 days  before the first class, then we are happy to  offer you a 70% refund.  Or see below for our credit policy.   At this point we have a much smaller  chance of booking another student after reserving this space for you!  As well, we have already booked our staff and paid our expenses for the  program. 

  • If you request a refund within 7  or less days before the first class, then we are happy to offer you a 35% refund. Or see below for our credit policy.  This is very hard on our small business.  At this point, we have already booked our staff, paid our expenses for this specific  program and organized all of our program details. 

  • Please note that no refunds or credits  are given once it is the first day of a program. 

Program Credit Policy: 

If you decide to change the program then you have   24 hours from when you made the purchase  to avoid any fees. This is  subject to spots being available for the program you want to apply your  credit to. 

Once the 24 hour grace period has expired then the following conditions apply: 

  • If you request to transfer programs with  30 days or more before the first class   and   spots for the  program you wish to transfer to are available then please send an E- transfer payment messaged “Transfer Of Program to your chosen date & location” to info@sparxstudioacting.com for $10/child/product. 

  • If you request to transfer programs  between  29 – 15  days  before the first class  and spots for the program you wish to transfer to  are available then please email  info@sparxstudioacting.com. In the e-transfer message please write the program you wish to be transferred to. However, only  90% of the payment will be applied towards the new program. There  will be an amount owing  if  the program you wish to transfer to  is of  the same or higher value of your original purchase.

  • If you request to transfer programs  between  14 – 8 days  before the first class  and spots for the program you wish to transfer to  are available then please email  info@sparxstudioacting.com. In the e-transfer message please write the program you wish to be transferred to. However, only  80% of the payment will be applied towards the new program. There  will be an amount owing  if  the program you wish to transfer to  is of  the same or higher value of your original purchase.

  • If you request to transfer programs  with 7  days or less  before the first class and spots for the program you wish to transfer to  are available then please email  info@sparxstudioacting.com. In the e-transfer message please write the program you wish to be transferred to. However, only  60% of the payment will be applied towards the new program. There  will be an amount owing  if  the program you wish to transfer to  is of  the same or higher value of your original purchase.

*All transfer request programs must be within 12 months of the original  program purchase start date. If not, no credit can be used and our refund policy will apply. *

*In the rare scenario if you have transferred  programs once, and you wish to transfer a second time, the original product you purchase’s  start date applies to all of these credit policies. *

*If Sparx Studio, our location facility, Ontario Government or City of Toronto decides to not allow in-person class(es) due to COVID-19 or conditions out of Sparx’s control, Sparx will offer  an alternative date or  a  discounted virtual course in its place. If not used, the customer may request a 70% refund  OR a full  credit minus an  Admin & Transfer  fee of   $20/program product purchased to be used within 12 months towards any future available program.*

*Promo Codes, Discounts & Special Sales: Customers can use these at the time of their current registration as long as it is still within the valid usage dates and for the correctly advertised product. Sparx Studio is not responsible nor will refund customers forgetting or missing out on a discount, promo or sale. *

*Please save all receipts and invoices sent from Sparx.  Our system automatically sends receipts and invoices when a payment is made through  our website.   We charge a $10 administrative fee if you request us to  send you  a new one.  If so, it can be sent via E-transfer to info@sparxstudioacting.com and please write in the message box ‘Invoice Request For _____’. (and insert the year or course you would like an invoice for).  

*Please note that if you cancel within 96  hours or less  before a Summer, Winter, March Break or other week long Camp begins due to a positive COVID result (with photo proof and dated within the last 96  hours) of the registered child ONLY, we will give you a full credit  towards another camp/program of your choice that has available space within a 12 month period. If you do not choose the credit option, we offer a 65% refund.  A positive COVID-19 result cannot be used towards cancellation  of any multi-week course or program or for notice over  96  hours before the first  class.

Program Pick Up/Late Policy: 

  • Program Pick Up Policy: We offer a one time  10   minute maximum  grace period for one late pick up only. After 10  minutes AND/OR  after 1 issued grace period from another class session,  there is a $1/minute  fee penalty for any late pick ups.   

Child Behavior Policies: 

Sparx Studio reserves the right to dismiss students from any program for  behaviors  including  but not limited to, excessive noise, destructive or unsafe behavior, harassment, hate speech, threats, and violence. If you are  contacted by one of our Instructors stating that your child has been doing at least 1  of these harmful  behaviors, you are required to pick them up immediately  and no refund will be received.  Please note that this is worse case scenario and that our instructors will always try to  avoid any situation like this ever occurring in the first place.  This policy is in place in order to  provide  a  safe and fun environment for all children and instructors.

Additionally, students must be able to fully regulate themselves in a group setting without any additional one on one support unless they bring someone qualified (such as a caregiver or parent) with them for the entire duration of the Program. Sparx will not be responsible or provide an additional staff member to assist. If a student is registered that does not meet these requirements and you cancel before the program begins, our standard Refund & Cancellation Policy applies. If you or Sparx discovers this after a program has begun and no additional care giver or parents can be present with the child, no refund will be given.

Students must be at least 4 years of age and fully toilet trained before the first day of any Program they are registered for.  If a student is under 4 years of age, had a bathroom accident,  and/or is without a parent or caregiver on site, Sparx has the right to call home for immediate pick up and no refund or credit  will be received. 

Child Protection

 

Sparx Studio Acting Inc. (Sparx) is dedicated to providing a safe and secure environment for all of our students. Sparx’s Child Protection Policy is available to all parents and staff.

 

A vital part of Sparx’s Child Protection Policy is that each class is overseen by a certified Sparx’s instructor. Every certified Sparx instructor must be fully trained in our curriculum and possess a cleared and valid Police Check, experience working with children, agree to a detailed Workplace Protocols & Policy contract (available upon request) which includes guidelines for their and the students’ safety & wellbeing, and up to date Standard First Aid-Level C for infants and children.

NOTICE FOR ONTARIO RESIDENTS: You have rights under the Consumer Protection Act, 2002.

By enrolling your child at Sparx Studio Acting Inc. (“Sparx” “we”, “our”, “us”), you accept these terms and conditions and accept this agreement to them as an ongoing agreement between you and Sparx (the “Agreement”).

The Agreement is made between the parent/guardian (“Parent”, “you” or “your”) of each enrolled student (“Student” or “Child”) by a Parent and Sparx , and is valid at all times whilst the Student is enrolled on any  Sparx activity and until such time as this agreement is terminated.

 1.  INTRODUCTION

1.1. These Terms & Conditions apply to all our Sparx Programs and any additional products and/or services offered by Sparx from time to time. We may update any aspect of these Terms & Conditions from time to time, as well as the prices at which any of our products or services are offered.

1.2. For participation of a Student in a Sparx activity all Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic registration form online. 

1.3. “Terms & Conditions” includes the terms of this Agreement and such other terms as may be detailed in fee receipt emails, Program confirmation email and other correspondence from us to you. 

1.4. A “Course” refers to a course of classes which will generally be delivered during the Term or season. Course classes usually take place once per week for a certain number of hours, as detailed at the time of booking. 

1.5. “Camps” refers to full day or half day programs that run during Holiday breaks or during the summer for 4 or 5 consecutive days, usually Monday-Friday.

1.6. “Manager” or “Supervisor” refers to the Manager or supervisor of a particular Sparx location.

1.7. “Season” refers to one normal academic term of Sparx during which Courses are run.

1.8. “Class Dates” refers to the dates of the relevant Program.

1.9. “Workshop” refers to a one-off course (including online activities) offering registration in educational context, drama and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) or more days and can run at any time throughout the year.

1.10. “Online Lesson” refers to one-off online streamed lessons and online workshops utilising Zoom or comparable platform.

1.11. “One on One Coaching” refers to a student and an instructor, typically via Zoom, doing one on one catered social-emotional lessons or acting lessons for a time or days chosen by the customer. 

1.12. “Class” refers to any individual session of a Program on a particular day.

1.13. “Program” refers to any of Sparx’s class, Course, Workshop, Camp, Online Lesson, Workshop, or One on One Coaching.

2.  ENROLLING A NEW STUDENT IN A SPARX’S PROGRAM

2.1. To apply for admittance for a new Student at Sparx, the Parent must agree to these Terms & Conditions, our Refund & Cancellation Policy and submit an application form online or by providing written consent by email.

2.2. All references to currency in these Terms & Conditions are in Canadian dollars.

2.2. Each Student’s place is allocated on a ‘first come, first served’ basis.

Prices for all Programs vary and are subject to change the next time it is run.

2.3. If Sparx is unable to accept a Student due to capacity reasons, the Student may, at the Parent’s discretion, be placed on a waiting list. 

Before a Student is placed on a waiting list, Sparx shall inform the Parent whether:

(i) if there is a deposit, and if so, it will be retained by Sparx while the Student is on the waiting list, or,

(ii) if no deposit is required, Sparx will notify the student that they will contact them to sign up within 24 hours from the time of notice was sent if a spot becomes available. If the student does not register within the 24 hours, the spot is forfeited and the next person in line will be contacted. 

In any event deposits or payments shall always be refunded, without interest, within ten (10) days of informing the Parent that the deposit is refundable for capacity reasons.

2.4. Times, current Season or Class Dates, fees and all relevant course details for Sparx activities will be confirmed in a Sparx confirmation email. If paid online, the parent will also receive automatic official receipts from the online payment platform. 

3. CANCELLATIONS

3.1. Cancellations are always permitted but the Sparx “Refund & Cancellation Policy” strictly applies.

3.2. After a first class in any Program has ended or a Program was cancelled (Program fees will always be offered back if a Program was cancelled) and a payment has not been requested back after 12 months for any Program, the payment is non-refundable and will be retained by Sparx. 

3.3.If a parent requests their desire to cancel after a program has begun, then the payment is not cancellable or refundable.

Your Rights under the Consumer Protection Act, 2002

In addition, there are grounds that allow you to cancel this agreement. You may also have other rights, duties and remedies at law. For more information, you may contact the Ministry of Consumer and Business Services.

To cancel this agreement, you must give notice of cancellation to Sparx, at the address set out in the agreement, by any means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of the supplier that is on record with the Government of Ontario or the Government of Canada or is known by you.

If you cancel this agreement and it is validated by Sparx, Sparx has fifteen (15) days to refund any payment you have made and return to you all goods delivered under a trade-in arrangement (or refund an amount equal to the trade-in allowance).

 4. BALANCE PAYMENTS

4.1. For any Sparx Program, payments are due when registered or enrolled

4.2 The payment must be paid in full, subject to any alternative agreements made with Sparx, by the first day of the program, by one of the following methods where offered:

Interac Email Transfer.

Website Payment by Credit Card, Visa and Mastercard.

4.3 Additional charges may be levied if a parent determines to pay by cheque, cash,  bank draft, or any other method besides the payment methods set forth in 4.2 above.

5. COURSES & AUTO RENEWALS

5.1.  Sparx, at its discretion, may offer a sibling rate or discounts during specific times and/or specific Programs. Only one discount may apply against the program fee for an individual child at any one time.

5.2. All Sparx registered customers will receive program information emails throughout the duration of their program length. This includes and is not limited to, location details, dates, times, special notes, feedback, showcase details and scripts.

5.3. If a program session falls on a statutory holiday or another day the location cannot facilitate, then a replacement class will be added onto the end of the current program timetable, extra minutes will be added to all of the remaining classes or the subsequent season on a date to be determined at Sparx’s discretion.

5.  COURSE TRIAL PERIODS

5.1. Where a new Student is attending a Program for the first time, subject to availability and the program being offered, Sparx may offer a first class discounted trial class or offer to have the child and parent observe the Class. 

5.2. Once you have notified Sparx that you wish to cancel, the Student may no longer attend the course or program.

5.4. If no cancellation is made in accordance with clause 5.2, the Agreement for the Course will continue for the duration of the season as long as the minimum number of students are remaining in the program.

 6. WORKSHOPS & HOLIDAY WORKSHOPS/CAMPS

6.1. If not already on Sparx’s website or social media, Parents should contact Sparx to confirm if it is organising Workshops and/or Holiday Workshops/Camps.

 6.2. Dates and times of Workshops and Holiday Workshops/Camps are released in advance on the Sparx website. 

7.  USE OF PERSONAL INFORMATION

7.1. Sparx’s Privacy Policy, a link for which can be found at the bottom on the Sparx’s website, applies to all Personal Information. A hard copy of the Privacy Policy can be requested by emailing Sparx Studio.

7.2.  Sparx owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, curriculum, schedules, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Program is owned by Sparx Studio Acting Inc.

8.  HEALTH AND SAFETY

8.1. Students participate at their own risk and either Parents or Students are obliged to inform Sparx and its staff of any existing injuries or medical conditions. All application forms must have any known medical conditions stated and any changes to such information must be notified to Sparx immediately in writing.

8.2. If you are unsure whether a Student should participate in any activity please consult the Student’s Doctor before enrolling the Student in a Sparx Program. The student and family are always welcome to contact Sparx in advance and ask for required information about student requirements for any Program.

8.3. Any medication left on the premises must be clearly labelled and the Student should, unless Sparx  has agreed in writing otherwise, be able to administer it themselves.

8.4. Students must provide & wear suitable weather appropriate footwear, clothing and bring their own snacks, full water bottle (and lunch if written in the Program information email.)

8.5. If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the contact details provided on the enrolment form. This number must always be contactable whilst the Student is attending the Sparx program.

8.6. Parents are solely responsible for ensuring that the contact details on Sparx records are up to date and entered correctly upon registration online.

8.7. Students must be at least 4 years of age and fully toilet trained before the first day of any Program they are registered for.   Full details are in our Refund & Cancellation Policy. 

8.8. 9.  PERSONAL PROPERTY

9.1. Students are obliged to take care of their own belongings.  Sparx accepts no liability for lost or damaged belongings.

10. GENERAL

10.1.  Sparx may, at its own discretion and without prior notice, refuse a Student entry to any class or Program for any reason whatsoever including, but not restricted to the Student’s behaviour. A list of these behaviours are included in our Refund & Cancellation Policy. If a child does 1 or more of these behaviours, the contact will be called immediately for pick up and no refund will be provided. 

10.2.  Sparx reserves the right to make changes to the timetable, teaching staff and advertised programme including the programme delivery mechanism (for clarity this could mean that we switch to online delivery of some lessons) in the event of illness or other circumstances beyond our control.

10.3. Where a class of a Sparx program has to be cancelled, Sparx will give as much notice as possible. In the event of a last minute class cancellation, you will be notified by email, text message, a call or through a designated Sparx social media site. Parents must ensure that they provide Sparx with up-to-date contact details. 

In the event of a Sparx Program or class being cancelled, Sparx will provide substitute lessons where possible in an alternate venue, time or online.  If no alternative can be offered, Sparx will provide percentage refunds for classes that are unable to be fulfilled as outlined in the Refund & Cancellation Policy. 

10.4. It is occasionally necessary to change the time and/or venue of a Sparx class. This will only be done if absolutely necessary and Sparx will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible.

10.5. In the event that a Student is unable to attend a Sparx class or program, due to sickness, conflicting activity, holiday or a decision by the Parent or Student not to attend, Sparx regrets that it is unable to refund any payment.

10.6. All Students must be collected on time by a Parent at the conclusion of each class.  Sparx is unable to supervise Students after a class and consistent late collection will result in additional charges.

10.7.  Sparx Program fees are reviewed seasonally and may be increased or decreased each year.

10.8. These Terms & Conditions, together with any receipt emails, confirmation emails, and/or information emails, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

10.9. In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

10.10. The Agreement shall be governed by, and construed in accordance with, the laws of Ontario of residence and any dispute, proceedings or claim shall be heard in the City of Toronto. 

Privacy Policy: 

Sparx Studio Acting Inc. (“Sparx” or “us” or “we”) is concerned about privacy issues and wants you to be familiar with how we collect, use and disclose information.

“Personal Information” is information that identifies you as an individual, such as:

  • Name

  • User name

  • Postal address (including billing and shipping addresses)

  • Telephone number (including home and mobile phone numbers)

  • Email address

  • Credit and debit card number

  • Profile picture

  • Social media account ID

  • Country of residence

If you submit any Personal Information relating to other people to us or to our service providers, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

To the extent permitted by applicable law, we may use Personal Information:

  • To respond to your inquiries and fulfill your requests, such as to send you newsletters or to respond to your questions and comments.

  • To send administrative information to you, for example, information regarding the Sites and changes to our terms, conditions, and policies.  Because this information may be important to your use of the Sites, you may not opt-out of receiving these communications.

  • To complete and fulfill your purchase, for example, to process your payments, provide services to you, communicate with you regarding your purchase and provide you with related customer service.

  • To provide you with updates and announcements concerning our services, promotions and programs and to send you invitations to participate in special programs.

  • To re-contact you if we have not heard from you in a while.

  • To send you advertising/promotional material.

  • To personalize your experience on the Sites by presenting products and offers tailored to you.

  • To process rewards and prizes, as applicable.

  • For our business purposes, such as analyzing and managing our businesses, market research, audits, developing new products, enhancing our Site, improving our services, identifying usage trends, determining the effectiveness of our promotional campaigns, tailoring the Sites experience and content based on your past activities on the Sites, and gauging customer satisfaction and providing customer service (including troubleshooting in connection with customer issues).

  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

To the extent permitted by applicable law, your Personal Information may be disclosed to our third party service providers who provide services such as website hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, customer service, email delivery services, credit card processing, auditing services and other services, to enable them to provide services.

We use a third party payment service to process purchases.  In these cases, your Personal Information may be collected by this third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy.  We have no control over, and are not responsible for, this third party’s use or disclosure of your Personal Information.

Any Personal Information provided to Sparx offline, from other sources or collected through your use of our website or services will be “processed” (as such terms are defined in the Data Protection Act 1998) by us for the purposes of administration, research, the provision of teaching services in educational drama, the organisation of performances and for the administration of Sparx’s statutory obligations under legislation relating to children. Sparx will not disclose this information to third parties for marketing purposes. Sparx itself may use this information for marketing its services. If you do not wish to receive marketing information from Sparx please note this in your registration notes or unsubscribe to any email at the bottom. 

By submitting an application form to Sparx you are consenting to the use of such Personal Information for the above purposes.

Sparx will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Sparx may change this Privacy Policy.  Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on this Site.  Your use of the Site following these changes means that you accept the revised Privacy Policy.

Wolf Athletic Academy Camp Waiver

This is a binding legal agreement As a Participant in the competitions, programs, activities and events of the W.O.L.F Athletic Academy the participant acknowledges and agrees to the following terms.
Description of Risks
 
1. In consideration of my participation in the competitions, programs, activities and events of
W.O.L.F Athletic Academy, I hereby acknowledge that I am aware of the risks and hazards
associated with or related to any such competitions, programs, activities and events, The risks
and hazards include, but are not limited to, injuries from
a) Physical contact with the instructor, students or other participants;
b) Striking students, participants, objects or equipment
c) Being struck by the instructor, students. participants, objects or equipment,
d) Contact, colliding, falling or being struck by other participants, spectators or equipment;
e) Executing strenuous and demanding physical techniques;
f) Vigorous physical exertion, strenuous cardiovascular workouts. rapid movements and quick
turns and stops; Exerting and stretching various muscle groups:
g) Dry land training including weights, running, circuit training and massage;
h) Extreme weather and temperature conditions which may result in heatstroke, sunstroke or
hypothermia;
i) Falling or colliding with the ring, walls, stands, equipment or with other participants;
j) Failure to properly use any piece of equipment or from the mechanical failure of any piece of
equipment;
k) Spinal cord injuries which may render me permanently paralyzed,
i) Travel to and from competitive events and associated non-competitive events which are an
integral part of W.O.L.F Athletic Academy competitions, programs, activities, and events.
 
2. Furthermore, I am aware
a) That injuries sustained can be severe;
b) That I may experience anxiety while challenging myself during the activities, events and programs.
c) That I may come into close contact with other participants;
d) That my risk of injury is reduced if I follow all rules established for participation; and
e) That my risk of injury increases as I become fatigued
 
Release of Liability and Disclaimer
 
3. In consideration of W.O.L.F Athletic Academy allowing me to participate, I agree,
a) That my physical condition has been verified by a medical doctor within the last six (6)
months;
b) To assume all risks arising out of, associated With or related to my participation and am fully
aware of the nature of these risks;
c) To be solely responsible for any injury, loss or damage that I might sustain while
participating; and
d) To RELEASE and DISCHARGE W.O.L.F Athletic Academy and collectively its respective directors, officers, committee members, clubs, members, employees, coaches, volunteers, officials, judges, participants, agents and representatives from any and all liability, for any and
all claims, demands, actions Judgments, executions and costs that might arise out of my participating, even though any such risks, injuries, loss, damage, clams, demands, actions or costs may have been caused by any manner whatsoever, including but not limited to, the negligence of W.O.L.F Athletic
Academy.

4. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs,
executors, administrators and representatives.
